New FASA CD-ROM Explains ‘Total Impact’ of AIA’s A201-2007 on Subcontractors

ALEXANDRIA, Va. — Change, as the saying goes, is good. However, changes that incorporate the worst business practices of the industry, including inappropriate shifting of risk to subcontractors, are not. For the first time in its history, the ASA chose not to endorse the new 2007 edition of the American Institute of Architects’ (AIA) Document A201 General Conditions of the Contract for Construction because the document contains changes from the 1997 edition of this document that can have a very important impact on subcontractors. For example, the A201-2007 provides less access to project financial information than the 1997 version of the A201. Such new limitations on rights flow through to subcontractors. Effects of important changes like this in the A201-2007 document are discussed in the latest multimedia CD-ROM from the Foundation of the American Subcontractors Association (FASA), “Total Impact: How the AIA A201-2007 Influences Subcontractor Rights, Responsibilities and Remedies,” now available at FASA’s Contractors’ Knowledge Depot.

“There are many reasons why the 2007 AIA documents are bad for both subcontractors and our industry, and this CD-ROM provides a comprehensive, in-depth account of what they are,” said ASA Executive Vice President E. Colette Nelson. “Employing this new resource can help subcontractors everywhere avoid the pitfalls these new documents contain,”

Led by David Hendrick, Esq., of Hendrick, Phillips, Salzman & Flatt, Atlanta, Ga., the CD-ROM offers subcontractors insight into this document’s risks, as well as an explanation of how it will interact with newer and older subcontract documents that are on the market. Produced from the third of eight webinars in ASA’s 2007-08 “Subcontractor Bidding and Negotiating Advantage Series,” this two-hour presentation also examines the document’s terms for payment, indemnification and insurance, delay damages, design responsibility, dispute resolution and general conditions.

The “Total Impact” CD-ROM contains an audio-visual recording, a media player to install on your computer, and installation instructions. The cost is $65 for ASA members and $95 for nonmembers.

ConsensusDOCS 750 Subcontract Provisions Explained in New FASA CD-ROM

ALEXANDRIA, Va. — For subcontractors and others in the construction industry, the release of the collaboratively developed 2007 ConsensusDOCS on Sept. 28, 2007, established a new “gold standard” for contractual relationships, creating new opportunities for increased project efficiency and profit. Aiding subcontractors in their pursuit of more equitable contract terms is “Maximum Value: Getting the Most From the New ConsensusDOCS Contractor-Subcontractor Agreement,” the latest multimedia CD-ROM from the Foundation of the American Subcontractors Association’s (FASA) Contractors’ Knowledge Depot.

Produced as the second of eight webinars in the American Subcontractors Association’s (ASA) 2007-08 “Subcontractor Bidding and Negotiating Advantage Series,” the webinar recorded on this CD-ROM covers the provisions subcontractors need to be familiar with in the ConsensusDOCS 750: Contractor/Subcontractor Agreement, including payment timing and final payment, retainage, indemnification, insurance options/requirements, delays, and claims for extra work.

“This new CD-ROM provides subcontractors with a clear explanation of the provisions detailed in the ASA-endorsed ConsensusDOCS 750 subcontract document and its benefits for subcontractors,” said ASA Executive Vice President E. Colette Nelson. “Armed with this resource, subcontractors across the country will understand the new options for contract negotiation the ConsensusDOCS 750 created for them.”

Led by ASA General Counsel Donald Gregory, Esq., of Columbus, Ohio-based Kegler, Brown, Hill & Ritter, the webinar presentation contained on this CD-ROM analyzes how this groundbreaking new document provides specialty trade contractors with smaller windows for progress payments, better terms regarding indemnification, and a reduced level of overall risk. During the program, subcontractors will also gain insight into how this model document will influence the proprietary subcontract agreements typically offered by general contractors and construction managers, and how references to the 750 document in their clients' documents can establish important rights.

The “Maximum Value: Getting the Most From the New ConsensusDOCS Contractor-Subcontractor Agreement” CD-ROM contains an audio-visual recording, a media player to install on your computer, and installation instructions. The cost is $65 for ASA members and $95 for

New FASA CD-ROM Explains Impact of ConsensusDOCS Owner-Contractor Agreement on Subcontractors

ALEXANDRIA, Va. — Understanding the 2007 ConsensusDOCS model contracts just got a whole lot easier for subcontractors. “New Directions: Navigating the Stage Set by the ConsensusDOCS Owner-Contractor Agreement,” the latest multimedia CD-ROM published by the Foundation of the American Subcontractors Association (FASA), provides subcontractors with key insights on how the highly anticipated ConsensusDOCS model owner-contractor agreement (2007) will impact them.

This multimedia recording of the first webinar in the American Subcontractors Association’s (ASA) 2007-08 “Subcontractor Bidding and Negotiating Advantage Series,” explains how the ConsensusDOCS owner-contractor agreement can set a stage of contractual rights, responsibilities and remedies that helps specialty trade contractors manage risk and succeed. In most cases, owner-contractor agreements are incorporated into subcontractor agreements and the rights and obligations of contractors described therein can “flow down” to subcontractors.

ConsensusDOCS is the new family of model contract documents based on best practices and proper risk allocation for the benefit of all members of the construction industry — and designed to increase efficiency in contract negotiations and project execution. ConsensusDOCS was developed by a collaboration of construction industry organizations, including ASA.

Presented by seasoned contract educator Russell O’Rourke, Esq., O’Rourke & Associates Company, L.P.A., Cleveland, Ohio, the webinar presentation contained on this easy-to-use CD-ROM examines the document’s terms for payment, indemnification and insurance, delay damages, design responsibility, dispute resolution and general conditions. It also offers insight into how the document will interact with newer and older subcontract documents.

The “New Directions: Navigating the Stage Set by the ConsensusDOCS Owner-Contractor Agreement” CD-ROM contains an audio-visual recording, a media player to install on your computer, and installation instructions. Subcontractors: Improve Your Next Contract’s Terms and Conditions

ALEXANDRIA, Va. — Nobody likes to do business completely on someone else’s terms. One of the greatest fears a construction subcontractor has is being forced to accept onerous contract terms and conditions in order to secure work. Indeed, with terms such as pay-if-paid and broad-form hold harmless pervading contracts, compromising principles can prove to be both risky and expensive. An easy way subcontractors can prevent this from happening is by conditioning their bids.

Conditioning a bid occurs when a subcontractor is able to include in its bid package a document that defines terms and conditions on which the bid is contingent. This may be possible only if the subcontractor is not required to bid the general contractor’s/construction manager’s terms and conditions. Learn how to use this effective method, including how and when to employ the ASA Subcontractor Bid Proposal form by purchasing the most recent multimedia CD-ROM published by the Foundation of the American Subcontractors Association (FASA), “Bidding Smarter With Bid Conditions.”

Presented by Scott Holbrook, Esq., of the law firm of Crawford & Bangs, Covina, Calif., the webinar recording contained on this easy-to-use CD-ROM offers advice on how to firmly establish your company’s acceptable terms and conditions, or starting-points for negotiating mutually acceptable terms and conditions, before you see your client’s proposed contract.

The “Bidding Smarter With Bid Conditions” CD-ROM contains an audio-visual recording, a media player to install on your computer, and installation instructions. FASA CD-ROM on Insurance Wrap-Ups Reveals Hidden Risks

ALEXANDRIA, Va. — Do you have questions about consolidated insurance programs (CIPs), or "wrap-ups"? Not sure why or how you should request a review of a CIP policy prior to entering into contract? Unsure about how wrap-ups are supposed to replace your standard coverage? As many subcontractors know, risk transfer can be costly. Learn what you need to know to protect your profits by purchasing the most recent multimedia CD-ROM published by the Foundation of the American Subcontractors Association (FASA), "Mind the Gaps: What Subcontractors Need To Know Before Jumping On Board an OCIP or CCIP Project."

Presented by risk transfer guru and construction veteran Richard Usher, Hill & Usher LLC, Phoenix, Ariz., the two-hour program contained on this easy-to-use CD-ROM offers advice on what every subcontractor needs to know before agreeing to work under an owner-controlled insurance program (OCIP) or contractor-controlled insurance program (CCIP).

A typical OCIP or CCIP project exposes subcontractors to risk and expenses in ways that are not always easy to anticipate. Learn critical questions to ask regarding the coverage, limits, and potential administrative burdens of wrap-up insurance programs. Don't pay the wrap-up premium and end up later regretting that you did not ask the right questions up-front. Look before you leap and be ready to decide when jumping on board is not right for you.

The "Mind the Gaps: What Subcontractors Need To Know Before Jumping On Board an OCIP or CCIP Project" CD-ROM contains an audio-visual recording of a live webcast, a media player to install on your computer, and installation instructions. The cost is $65 for members of the American Subcontractors Association and $95 for nonmembers. Stake Your Claim With the 2006 Edition of Lien & Bond Claims in the 50 States

ALEXANDRIA, Va. — Construction subcontractors that regularly perform work in more than one state know how difficult it is to stay on top of various mechanic’s lien and payment bond filing requirements. Because of nuances in state laws, claims procedures and deadlines vary widely. One handy reference provides subcontractors with current, critical information for filing claims — no matter where in the United States they do business: the Foundation of the American Subcontractors Association’s (FASA) 2006 edition of Lien & Bond Claims in the 50 States.

Probably no attorney in the United States would claim to be an expert on the mechanic’s lien laws of all 50 states and the District of Columbia. Nevertheless, courts generally require strict compliance with applicable lien statutes if a lien is to be valid. And just as lien laws vary, statutes governing bond claims on public work also vary from state to state, and require strict compliance. “Substantial compliance” won’t do.

The updated 2006 edition of FASA’s Lien & Bond Claims in the 50 States CD-ROM gives subcontractors a solution with: the latest lien claim requirements for each state; critical filing deadlines; legal requirements for executing bond claims; and exceptions to claims procedures.

This easy-to-use CD-ROM divides the various lien and bond requirements for each state and the District of Columbia by public and private work, putting lien laws and bond requirements right at the reader’s fingertips. It also explains various legal requirements for executing bond claims, and contains information about whom to notify of claims, critical deadlines for filing paperwork, and an appendix featuring a chart of legal citations.

Lien & Bond Claims in the 50 States is $42 for members of the American Subcontractors Association and $50 for nonmembers. Order this reference online through FASA’s Contractors’ Knowledge Depot at www.contractorsknowledgenetwork.org or call toll-free 1-888-374-3133.
